Six official measures to relax the scope of social capital to organize medical institutions

The General Office of the State Council recently forwarded the "Opinions on Further Encouraging and Guiding Social Capital to Organize Medical Institutions" of the Development and Reform Commission, the Ministry of Health, the Ministry of Finance, the Ministry of Commerce, and the Ministry of Human Resources and Social Security. In response to the current difficulties in the introduction of medical institutions in social capital and the problem of many restrictions, the Opinions proposed six measures to ease the scope of admission of social capital to medical institutions.

The six measures are:

First, encourage and support social capital to organize various types of medical institutions. Social capital may independently bid for profit or non-profit medical institutions according to its business objectives. Health, civil affairs, industry and commerce, taxation and other relevant departments shall be registered and classified according to law.

Second, adjusting and adding medical and health resources give priority to social capital. When formulating and adjusting regional health plans, medical institution setting plans, and other medical and health resource allocation plans in the region, it is necessary to leave reasonable space for non-public medical institutions. When it is necessary to adjust and add new medical and health resources, priority should be given to organizing medical institutions from social capital, subject to the criteria for admission.

Third, reasonably determine the scope of practice of non-public medical institutions. The health department is responsible for reviewing the categories of non-public medical institutions, diagnosis and treatment subjects, beds, etc., to ensure that the scope of practice of non-public medical institutions is commensurate with their service capabilities. Those who meet the conditions for bids and have corresponding qualifications shall be approved and issued corresponding licenses in a timely manner, and shall not limit the scope of practice of non-public medical institutions for no reason.

Fourth, encourage social capital to regulate participation in public hospital restructuring. We have guided social capital to participate in the reform of public hospitals, including hospitals run by state-owned enterprises, in various ways. We have actively and steadily converted some public hospitals into non-public medical institutions and moderately reduced the proportion of public hospitals.

V. Further expand the opening of medical institutions to the outside world, and adjust foreign medical institutions to be foreign investment projects. Allow overseas medical institutions, enterprises and other economic organizations to set up medical institutions in the form of joint ventures or cooperation with China's medical institutions, enterprises and other economic organizations in China, and gradually cancel restrictions on the proportion of equity in overseas capital. The capitals of Hong Kong, Macao Special Administrative Region and Taiwan Region hold medical institutions in the Mainland and enjoy preferential support policies in accordance with relevant regulations.

6. Simplify and standardize the approval procedures for foreign-funded medical treatment. The establishment of Chinese-foreign joint ventures and cooperative medical institutions shall be examined and approved by the provincial-level health department and commercial department. The establishment of Chinese medicine, integrated traditional Chinese and Western medicine, and ethnic medicine hospitals shall seek the advice of the provincial Chinese medicine administrative department. The establishment of a wholly foreign-funded medical institution shall be examined and approved by the Ministry of Health and the Ministry of Commerce. The establishment of Chinese medicine, integrated Chinese and Western medicine, and national medical hospital shall seek the advice of the State Administration of Traditional Chinese Medicine. The specific measures will be formulated by the relevant departments.
